Hospitappity LLC
Terms of service
Last updated October 12, 2026
The short version: no setup fee, no per-order fees, 12-month or month-to-month, and your domain, accounts, content and data are yours to take with you any time.
We've written this in plain English on purpose, so you can read it in a few minutes and know exactly where you stand. If anything is unclear, ask us and we'll explain.
1. These terms
These terms are the agreement between Hospitappity LLC (“Hospitappity”, “we”), a Florida company, and the business that signs up for our service (“you”). By signing up or using the owner portal, you agree to them. If you sign up on behalf of a business, you're confirming you can agree for it.
These terms, our privacy policy, and any written quote we agree with you are the whole agreement. If a written quote says something different from these terms, the quote wins.
2. What we provide
We build and run the products in your package: a website on your own domain, your own app in the App Store and Google Play, local search work, or a combination. What each package includes is described on our pricing page or in your written quote. We set it up with you, keep it working as phones and browsers change, and support you directly.
3. Price, commitment and billing
- Your choice of terms (12-month or month-to-month). Choose a 12-month agreement at our best price, or month-to-month at a slightly higher one. Both prices are published for every package. After 12 months, a 12-month agreement continues month-to-month at the same price, unless you choose another 12 months.
- Month-to-month: cancel any time with one email. There's no cancellation fee, and your service runs to the end of the month you've paid for.
- 12-month agreement: you're committed for the year. If you need to end it early, the remaining months are still due, unless we agree otherwise in writing.
- No setup fee, and every location of your business is included at no extra cost.
- No per-order fees, ever. We never charge per order, per booking, per lead or per job, and we never take a percentage of your sales. Order and booking buttons link to the services you already use; we don't process your orders or payments.
- Billing. We bill monthly, in advance, by invoice. Prices are in US dollars. Apple and Google charge their own fees for your developer accounts, which you pay them directly.
- Price changes. We'll email you at least 30 days before a price change. During a 12-month agreement, your price doesn't change.
4. You own your domain, accounts, content and data
Your business owns its domain name, its Apple and Google developer accounts and the app listings in them, its content (words, photos, prices, hours, events), and its data, including everything its customers give it. You can download all of it from Settings in the portal, at any time, without asking us.
You give us permission to store, copy, display and adapt your content only to provide the service, for example resizing your photos or showing your hours to search engines. That permission ends when you leave and your data is deleted.
We own the Hospitappity software: the code, designs and templates that run your app and website. You can use it while you're a customer.
5. Your responsibilities
You're responsible for running your business lawfully, and that includes what your app and website say and how you contact your customers. In particular:
- your licences and permits;
- the rules for what you sell and how you advertise it, such as alcohol age limits and advertising rules, and your profession's advertising and disclosure rules;
- the accuracy of your prices, hours, offers and claims;
- the rules for emailing and texting your customers. Our sign-up forms record your customers' consent for you; message only people who asked to hear from you;
- your customers' information: you decide what to collect and answer their requests about it. We process it for you as our privacy policy describes.
We build in tools that help, like age confirmation, consent records and disclosure footers, but we're not your lawyer or compliance officer, and you approve what your app and website say. Keep your portal sign-in secure, and remember that the team members you invite act for your business.
6. Acceptable use
You agree not to use Hospitappity to:
- break the law, or publish anything illegal, misleading or that infringes someone else's rights;
- send messages to people who didn't ask for them;
- attack the service, try to reach another business's information, or upload anything harmful.
For now, we don't build for some kinds of business, because of app store, advertising or legal restrictions (for health practices, the rules for patient information): adult business, cannabis dispensary, chiropractor, credit repair, debt settlement, dentist, firearms dealer, gambling and betting, home health care, immigration consultant (non-attorney), investment promoter (non-advisor), med spa, optometrist or eye care, orthodontist, payday and short-term lender, pharmacy, physical therapist, physician or medical practice and therapist or counselor. If your business becomes one of these, we may end the service as described in section 9.
7. Keeping things running
We work hard to keep your app and website fast and available, and we fix problems quickly when they happen. But we can't promise the service will never be interrupted or free of errors: it also depends on providers like Apple, Google, Cloudflare and Supabase. Whether and when an app is approved is up to Apple and Google.
We improve the service over time. We won't remove a feature you pay for without telling you first.
8. Limits on liability
Apart from what these terms promise, we provide the service as it is, without other guarantees. Neither of us is responsible to the other for indirect losses, such as lost profits or lost business. Our total responsibility for any claim is limited to what you paid us in the 12 months before it arose.
If someone makes a claim against us because of your content or how you run your business (for example, a message sent without consent), you'll cover the cost of that claim.
Nothing in these terms limits a responsibility that the law doesn't allow to be limited.
9. Ending the service, and your data
You can end the service as described in section 3. We can end it with 30 days' notice, or straight away if you seriously break these terms (for example, illegal use, or invoices left unpaid after reminders).
When the service ends:
- your domain, developer accounts, content and data stay yours. For 30 days, you can still sign in and download everything, or ask us and we'll send it to you;
- we help you point your domain elsewhere, and we stop running your website and updating your app;
- your app's listing stays in your own Apple and Google accounts, where you can remove it or publish a new version with someone else;
- after the 30 days, we delete your business's information, as our privacy policy describes.
10. Changes to these terms
If we change these terms, we'll update this page and the date at the top. For a change that matters to you, we'll email the owner at least 30 days before it takes effect, and if you don't agree, you can leave before then with no early-termination charge.
11. Florida law
These terms are governed by the laws of the State of Florida. If we disagree, let's talk first: most things are sorted out with a phone call. If we can't resolve it, the state or federal courts in Brevard County, Florida, will decide.
